How to Obtain a Green Card​?

​

A Green card can be obtained  in several ways

  • Diversity Visa Green Card Lottery

  • Marriage

  • Adjustment of Status

  • Qualify for Asylum

  • Through an immediate family member with a United States Citizen (USC ) or current green card holder

    • Marry a USC or  Legal Permanent Resident (LPR) and apply for a marriage visa or Adjustment of Status​

What is the Process for Obtaining a Fiancee or K1 Visa?

  • USC Fiancee files a I-29F

  • ​Allows a foreign national to enter into the US up to 90 days for the purpose of marrying a USC. Fiancees of US Lawful Permanent residents cannot obtain this type of visa.​

  • Must be eligible to marry​
    • Must have met each other at least two years prior to submitting the Fiancee Visa Application unless waived due to customs, religion, or hardship.

  • To qualify, the foreign significant other must intend to marry the USC in 90 days of arrival.

What is a K2 Visa?

  • a visa for the child of the Foreign National Fiancee.

What are the eligibility requirements for applying for Adjustment of Status?

  • A USC and anyone who entered the United States legally regardless if overstayed;

  • Possess a valid visa and entered the United States legally and must not have been unlawfully present or worked illegally;

  • Those protected by 245(i) of the INA; and

  • Immigrants who entered on a K1 Visa (Fiancee) and subsequently married their USC Petitioner within 90 days of entry.

Are they any concerns before considering applying for Naturalization (Form N-400)?

  • If a non-immigrant is seeking naturalization, it is important that he or she is not subject to deportation for prior immigration or criminal violations before sending anything to immigration officials.
